Definitions

Client: any professional, natural person, or legal entity who visits the Website subject to these general terms and conditions.
Services: www.allingua.lu provides Clients with Services.
Content: all elements constituting the information on the Website, including texts, images, and videos.
Client Information: hereinafter “Information,” meaning all personal data that may be held by www.allingua.lu for managing your account, customer relations, and for analysis and statistical purposes.
User: an internet user connecting to and using the aforementioned Website.
Personal Information: “Information which makes it possible, in any form whatsoever, directly or indirectly, to identify the natural persons to whom it applies.”

The terms “personal data,” “data subject,” “processor,” and “special category data” have the meaning given by the General Data Protection Regulation (GDPR: No. 2016-679).

General terms of use of the site and services provided

The Website constitutes an intellectual work protected by the provisions of the Intellectual Property Code and applicable international regulations. The Client may not in any way reuse, transfer, or exploit for their own account all or part of the elements or works on the Website.
Use of www.allingua.lu implies full and complete acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time; users of www.allingua.lu are therefore invited to consult them regularly.
This website is normally accessible to users at all times. An interruption for technical maintenance may, however, be decided by Allingua, which will endeavor to inform users in advance of the dates and times of the intervention. The website www.allingua.lu is updated regularly. Likewise, this Legal Notice may be modified at any time; it is nevertheless binding on the user, who is invited to refer to it as often as possible to take note of any changes.


Description of services provided

The website www.allingua.lu aims to provide information concerning all of the company’s activities. Allingua strives to provide information on www.allingua.lu that is as accurate as possible. However, it cannot be held liable for omissions, inaccuracies, and failures to update, whether caused by Allingua or by third-party partners who provide such information.

All information indicated on www.allingua.lu is provided for guidance only and is subject to change. Moreover, the information on www.allingua.lu is not exhaustive. It is provided subject to modifications having been made since it was put online.


Contractual limitations on technical data

The Website uses JavaScript, HTML, and CSS technologies. Allingua cannot be held liable for material damage related to the use of the site. In addition, the user agrees to access the site using recent equipment, free of viruses, with an up-to-date, latest-generation browser. The website www.allingua.lu is hosted by a provider located within the territory of the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: No. 2016-679).

The objective is to provide a service with the best possible accessibility rate. The host ensures continuity of service 24 hours a day, every day of the year. However, the host reserves the right to interrupt the hosting service for the shortest possible periods, in particular for maintenance, improvement of its infrastructure, infrastructure failure, or if the Services generate traffic deemed abnormal.
Allingua and the host cannot be held responsible in the event of Internet network malfunctions, telephone line failures, or computer/telephony equipment issues, notably due to network congestion preventing access to the server.


Intellectual property and counterfeiting

Allingua owns the intellectual property rights and holds the rights of use for all elements accessible on the website, including texts, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the site, regardless of the means or process used, is prohibited without prior written authorization from Allingua.
Any unauthorized use of the site or any of its elements will be considered an infringement and prosecuted.


Limitations of liability

Allingua acts as the publisher of the site and is responsible for the quality and accuracy of the Content it publishes.
Allingua cannot be held liable for direct or indirect damage caused to the user’s equipment when accessing www.allingua.lu, resulting either from use of equipment that does not meet the specifications indicated in Section 4, or from the appearance of a bug or incompatibility.
Allingua also cannot be held liable for indirect damages (such as loss of market or loss of opportunity) resulting from the use of www.allingua.lu.

Interactive spaces (e.g., the ability to submit questions in the contact area) are available to users. Allingua reserves the right to delete, without prior notice, any content posted in this space that contravenes applicable law in Belgium, particularly provisions relating to data protection. Where appropriate, Allingua also reserves the right to pursue the user’s civil and/or criminal liability, especially in the case of messages of a racist, insulting, defamatory, or pornographic nature, regardless of the medium used (text, photograph, etc.).


Management of personal data

Data collection controllers

For Personal Data collected as part of creating the User’s personal account and browsing the Website, the controller is: Allingua.
As the controller of the data it collects, Allingua undertakes to comply with applicable legal provisions. In particular, it is responsible for establishing the purposes of its processing, providing prospects and clients—with their consent upon collection—complete information on the processing of their personal data, and maintaining a processing register that reflects reality. Whenever Allingua processes Personal Data, it takes all reasonable measures to ensure that the Personal Data is accurate and relevant for the purposes for which it is processed.

Purposes of data collected

Allingua may process some or all of the data:

  • to enable browsing on the Website and to manage and track services and orders placed by the user: connection and site-usage data, invoicing, order history, etc.;
  • to prevent and combat computer fraud (spamming, hacking, etc.): hardware used for browsing, IP address, password;
  • to improve browsing on the Website: connection and usage data; to conduct optional satisfaction surveys about Allingua: email address;
  • to conduct communication campaigns (SMS, email): phone number, email address.
    Allingua does not sell your personal data, which is used only as necessary or for statistical and analytical purposes.

Right of access, rectification, and objection

In accordance with European regulations in force, Users of www.allingua.lu have the following rights:

  • right of access (Art. 15 GDPR), rectification (Art. 16 GDPR), updating, and completion of Users’ data; right to lock or erase Users’ personal data (Art. 17 GDPR) when it is inaccurate, incomplete, ambiguous, outdated, or when collection, use, communication, or storage is prohibited;
  • right to withdraw consent at any time (Art. 13(2)(c) GDPR);
  • right to restriction of processing (Art. 18 GDPR); right to object to processing (Art. 21 GDPR);
  • right to data portability for data provided by Users where processing is automated and based on consent or a contract (Art. 20 GDPR);
  • right to define the fate of Users’ data after their death and to choose to whom Allingua should (or should not) disclose their data to a third party previously designated.
    As soon as Allingua becomes aware of a User’s death and in the absence of instructions from them, Allingua undertakes to destroy their data, unless retention proves necessary for evidentiary purposes or to meet a legal obligation.
    If a User wishes to know how Allingua uses their Personal Data, to request rectification, or to object to processing, the User may contact www.allingua.lu in writing at:

    In this case, the User must specify the Personal Data that they would like Allingua to correct, update, or delete, and must identify themselves precisely with a copy of an identity document (ID card or passport).
    Requests for deletion of Personal Data will be subject to the obligations imposed on Allingua by law, particularly regarding document retention or archiving. Finally, Users of www.allingua.lu may lodge a complaint with the supervisory authorities, in particular the Commission nationale pour la protection des données (CNPD) (https://cnpd.public.lu).

Non-disclosure of personal data

Allingua undertakes not to process, host, or transfer Information collected about its Clients to a country outside the European Union or recognized as “not adequate” by the European Commission without prior notice to the client. However, Allingua remains free to choose its technical and commercial processors, provided they offer sufficient guarantees with regard to GDPR requirements (GDPR: No. 2016-679).
Allingua undertakes to take all necessary precautions to preserve the security of the Information, and in particular that it is not disclosed to unauthorized persons. However, if an incident affecting the integrity or confidentiality of Client Information comes to Allingua’s attention, it must inform the Client as soon as possible and communicate the corrective measures taken.

Users’ Personal Data may be processed by Allingua’s processors (service providers) solely to achieve the purposes of this policy.
Within the limits of their respective roles and for the purposes mentioned above, the main persons likely to have access to Users’ data on www.allingua.lu are primarily Allingua staff members.


Incident notification

Despite best efforts, no method of transmission over the Internet and no method of electronic storage is completely secure. We therefore cannot guarantee absolute security. If we become aware of a security breach, we will notify the affected users so that they can take appropriate measures. Our incident notification procedures take into account our legal obligations at national and European level. We undertake to fully inform our clients of all matters relating to the security of their accounts and to provide all necessary information to help them meet their own regulatory reporting obligations.

No personal information of the user of www.allingua.lu is published without the user’s knowledge, exchanged, transferred, assigned, or sold on any medium to third parties. Only the hypothetical acquisition of www.allingua.lu and its rights would allow the transmission of said information to the potential buyer, who would in turn be bound by the same obligation to retain and modify data with respect to the user of www.allingua.lu.


Security

To ensure the security and confidentiality of Personal Data, Allingua uses networks protected by standard devices such as firewalls, pseudonymization, encryption, and passwords.

When processing Personal Data, Allingua takes all reasonable measures to protect it against loss, misuse, unauthorized access, disclosure, alteration, or destruction.


Hyperlinks, cookies, and internet tags

The website www.allingua.lu contains a number of hyperlinks to other sites, set up with Allingua’s authorization. However, Allingua is not able to verify the content of the sites visited in this way and consequently assumes no responsibility for them.
Unless you decide to disable cookies, you accept that the site may use them. You can disable these cookies at any time and free of charge using the deactivation options available to you and described below; however, this may reduce or prevent access to all or part of the services offered by the site.


“Cookies”

A “cookie” is a small information file sent to the User’s browser and stored within the User’s terminal (e.g., computer, smartphone) (hereinafter “Cookies”). This file includes information such as the User’s domain name, the User’s internet service provider, the User’s operating system, as well as the date and time of access. Cookies cannot damage the User’s terminal.
Allingua may process the User’s information regarding visits to the Site, such as pages viewed and searches conducted. This information enables Allingua to improve the content of the Site and the User’s browsing experience.
Because Cookies facilitate navigation and/or the provision of services offered by the Site, the User can configure their browser to decide whether or not to accept them, so that Cookies are stored in the terminal or, on the contrary, rejected, either systematically or depending on the issuer. The User can also configure the browser software so that acceptance or refusal of Cookies is offered from time to time, before a Cookie is likely to be stored in the terminal. Allingua informs the User that, in this case, some functionalities of the browser software may not be available.

If the User refuses the storage of Cookies in their terminal or browser, or if the User deletes those stored there, the User is informed that their browsing and experience on the Site may be limited. This may also occur when Allingua or one of its providers cannot recognize, for compatibility purposes, the type of browser used by the terminal, the language and display settings, or the country from which the terminal appears to be connected to the internet.

Where applicable, Allingua disclaims all responsibility for the consequences related to the degraded operation of the Site and any services possibly offered by Allingua resulting from (i) the User’s refusal of Cookies or (ii) Allingua’s inability to store or consult the Cookies necessary for their operation due to the User’s choices. For managing Cookies and User choices, each browser is configured differently. This configuration is described in the browser’s help menu, which will allow the User to know how to modify Cookie preferences.
At any time, the User may choose to express and modify their Cookie preferences. Allingua may also use external service providers to help collect and process the information described in this section.

Finally, by clicking on the social network icons for Twitter, Facebook, LinkedIn, Instagram, and X on the www.allingua.lu Website—and if the User has accepted the deposit of cookies by continuing to browse—Twitter, Facebook, LinkedIn, Instagram, and X may also place cookies on your devices (computer, tablet, mobile phone).

Internet “Tags”

Allingua may occasionally employ internet tags (also known as “tags,” action tags, single-pixel GIFs, clear GIFs, invisible GIFs, and one-by-one GIFs) and deploy them through a web analytics partner that may be located (and therefore store the corresponding information, including the User’s IP address) in a foreign country.

These tags are placed both in online advertisements that enable internet users to access the Site and on various pages of the Site itself.
This technology allows Allingua to evaluate visitor responses to the Site and the effectiveness of its actions (for example, the number of times a page is opened and the information viewed), as well as the User’s use of the Site.

The external provider may collect information about visitors to the Site and other websites through these tags, compile reports on Site activity for Allingua, and provide other services relating to the use of the Site and the internet.


Applicable law and jurisdiction

Any dispute related to the use of www.allingua.lu is subject to Luxembourg law. Except where the law does not permit it, exclusive jurisdiction is assigned to the competent courts of Luxembourg City.
